CONDITIONS FOR PARTICIPATION IN THE FESTIVAL – VISITOR RULES

1. Introductory Provisions

1.1 This visitor rule is a directive issued by the company Společně o.p.s., based in Brno-střed, Staré Brno, Mendlovo náměstí 907/1a, file number O 266 registered at the Regional Court in Brno (hereinafter referred to as the “operator” or “organizer”), which establishes the basic binding rules for individuals entering the premises of the Mendel festival and using the facilities located in the Mendel festival area (hereinafter referred to as the “visitor rules”).

1.2 The purpose of the visitor rules is primarily to ensure safety, fire protection, hygiene, health protection, and property protection at the Mendel festival, as well as to secure ideal conditions for the course of all events (hereinafter referred to as “events”) that will be part of the Mendel festival. The aim of the visitor rules is also to ensure a pleasant social atmosphere in the Mendel festival area.
 
1.3 The Mendel Festival area for the purposes of these visitor rules refers to the area of the University Campus Bohunice.

1.4 By entering the festival, each visitor expresses their consent to the conditions set forth in these visitor rules, and at the moment of entering the festival area, these visitor rules become binding for each visitor for the entire duration of their stay. A visitor and/or the public for the purposes of these visitor rules refers to any person entering the Mendel festival area, including media representatives and technical staff.

1.5 The provisions of these visitor rules shall also apply similarly to individuals entering the Mendel festival area based on a special contractual relationship with the operator and/or its contractual partners.

2. The Mendel festival area

2.1 Supervision over compliance with and respect for these visitor rules in the Mendel festival area is carried out by duly designated employees of the operator and other persons duly authorized and designated by the operator, and within the scope of their legal powers, also by the Police of the Czech Republic and the Municipal Police of Brno.

2.2 Individuals under the influence of alcohol or other addictive and narcotic substances, as well as individuals whose behavior threatens the safety and/or health of persons and/or property located in the Mendel festival area, lose the right to stay in the Mendel festival area and may not be admitted to the Mendel festival area and/or may be removed from the Mendel festival area by the organizer’s staff and/or a person authorized by the organizer and/or security service. Similarly, individuals who violate the rules set forth in these visitor rules and/or individuals who do not respect the instructions of the organizer’s staff and/or persons authorized by the organizer may not be admitted to the Mendel festival area and/or may be removed from the Mendel festival area.

2.3 The sale of tobacco and alcoholic products to persons under the age of 18 is prohibited in the Mendel festival area.

3. Responsibilities of Visitors

3.1 Visitors to the Mendel festival are obliged to behave in its area in such a way that their actions do not threaten the safety and/or health of third parties and/or their property, as well as the facilities located in the Mendel festival area, and further, their behavior does not restrict, threaten, or disturb other visitors beyond what is reasonable given the circumstances arising from the course of the Mendel festival.
 
3.2 Visitors to the Mendel festival are obliged to follow the instructions and regulations of the organizer’s staff and/or persons authorized by the organizer and/or the security service, as well as the instructions and regulations of the Police of the Czech Republic, the Municipal Police of Brno, the Fire Rescue Service of the South Moravian Region, the Volunteer Fire Brigade of Královo Pole, and the Emergency Medical Service of the South Moravian Region.
 
3.3 Visitors to the Mendel festival are obliged to respect the rules arising from these visitor rules, generally binding legal regulations, as well as rules of decent behavior and good manners.
 
3.4 Visitors to the Mendel festival are prohibited from bringing the following items into the Mendel festival area:
a) racist, derogatory, vulgar, or other materials contrary to good morals;
b) weapons of any kind, as well as all items usable as cutting, stabbing, or striking weapons or other items that could threaten the safety, health, or life of visitors (e.g., scissors, etc.);
c) sprays, corrosive, flammable (e.g., perfumes in containers over 200 ml), explosive, coloring, or other substances threatening health;
d) bottles, containers, cans, or other items made of brittle, shattering, or exceptionally hard materials;
e) fireworks/rockets, flares, smoke bombs, and other pyrotechnic items or firing devices;
f) alcoholic beverages and/or addictive and narcotic substances;
g) animals of any kind, except for assistance dogs according to Act No. 329/2011 Coll., on the provision of benefits to persons with disabilities;
h) materials promoting a political party or movement, or any politically oriented materials;
i) excessive luggage and baggage, bicycles;
j) umbrellas, psychotropic substances,
k) laser pointers,
l) recording devices, film cameras, and video cameras, professional and semi-professional cameras and DSLRs.

The operator or authorized persons have the right to decide on the danger and/or unsuitability of individual items brought by visitors into the Mendel festival area, especially the head of the security service and/or their superiors. Checks may be conducted upon entry to the area or at any time after the visitor has entered the Mendel festival area.

3.5 Visitors to the Mendel festival are obliged to allow the operator’s staff and/or persons authorized by the operator to inspect the items and luggage brought in for the purpose of checking compliance with the previous provision. If a visitor refuses to undergo an inspection under this provision, they may not be admitted to the Mendel festival area and/or may be removed from the Mendel festival area.

3.6 Visitors to the Mendel festival agree to undergo a security check for the purpose of checking compliance with these visitor rules, both for baggage checks and personal checks by the operator’s staff and/or persons authorized by the operator and/or the security service, upon entering the Mendel festival area. If a visitor refuses to undergo a security check, they may not be admitted to the Mendel festival area and/or may be removed from the Mendel festival area.

3.7 Visitors to the Mendel festival are further prohibited from:
a) expressing, spreading, or publicly promoting racist, derogatory, vulgar, or slogans or images contrary to good morals and/or inciting others to such behavior;
b) promoting any political party or movement, or any product or service;
c) climbing or entering any buildings and facilities in the area, especially facades, fences, walls, barriers, lighting devices, trees, poles, roofs, barriers, supporting structures, etc.;
d) entering areas that are not designated for the public and are marked as inaccessible for these purposes;
e) throwing any objects into areas where visitors are present, especially into sports fields, stages, and auditoriums;
f) making any audio or visual recordings in the Mendel festival area for commercial purposes or photographing any performances with professional and semi-professional cameras and DSLRs without prior written consent from the operator;
g) smoking outside of designated areas marked by the operator;
h) bringing beverages into the Mendel festival area;
i) starting a fire, igniting, or detonating any pyrotechnics;
j) arbitrarily moving or otherwise manipulating the equipment and/or furnishings located in the area;
k) manipulating in any way with the water, electricity, air, or other systems in the area;
l) damaging any equipment and furnishings located in the area, including park trees and grasses;
m) describing, sticking, or painting any equipment, furnishings, or communications in the area;
n) performing bodily functions outside of toilets or otherwise polluting the area;
o) entering the area without prior consent or instructions from the operator and/or an authorized person;
p) threatening violence and/or committing it against an individual and/or a group of people and/or inciting others to such behavior;
q) selling any goods without permission,
r) distributing or placing any promotional and advertising materials in the festival area without written permission from the organizer!

3.8 Visitors are not entitled to engage in any business or similar activities in the Mendel festival area without prior written consent from the operator and/or in violation of the conditions of the granted written consent from the operator, nor to distribute and/or sell any items to other visitors, including newspapers, magazines, printed materials, advertising brochures, etc., nor to store any items in the Mendel festival area.

3.9 A participant in the festival participates in the festival solely at their own risk and is responsible for any damage they cause.

3.10 A participant in the festival commits to ensuring safety
a) in the event of a fire, natural disaster, or other emergency, to provide reasonable personal assistance, unless doing so would expose themselves or close persons to serious danger or risk, or if an important circumstance prevents them from doing so, and to provide necessary material assistance.
b) to dispose of ash and cigarette butts and other tobacco products exclusively in containers designated by the organizer in accordance with hygiene rules according to Act No. 258/2000 Coll., on the protection of public health, as amended. To ensure safety when lighting tobacco products (matches, lighters).
c) not to smoke in buildings and areas marked with a “No Smoking” sign.
d) not to damage installed safety signage.
e) not to damage or in any way restrict the use of installed portable fire extinguishers.
f) not to damage or in any way restrict the use of hydrant systems or other fire safety devices.
g) not to damage and not to interfere with installed electrical devices in any way.
h) not to damage or in any way restrict the use of control elements of installed technical devices (distribution cabinets of electrical devices, main switches, main water shut-off valves, etc.).
i) in the event of a fire alarm, to follow the instructions of the event organizer, members of the preventive fire patrol, security members, or members of the intervening components of the integrated rescue system.

3.11 Visitors to the festival acknowledge that operational and hygiene rules for the use of toilets, washrooms, and other facilities may be published separately in the form of an operational order, which is binding in accordance with Act No. 258/2000 Coll., on the protection of public health.

4. Liability for Damage

4.1 The organizer is not liable for damage to property or health of festival participants unless this damage is caused by a violation of legal regulations by the organizer and in direct connection with this violation. The organizer’s liability for damage is limited to an amount corresponding to the maximum price of the ticket purchased by the participant.
 
4.2 Visitors, especially the elderly or those with physical disabilities, must move cautiously on smooth and uneven surfaces and avoid injury. The organizer is not liable for harm caused by an injury that the visitor caused by their own negligence or by not adhering to the visitor rules.

4.3 Visitors are obliged to return to the operator and/or a person authorized by the operator and/or the security service all items found in the Mendel festival area.

In the event that visitors find any suspicious items in the Mendel festival area, or items that could threaten property, lives, and/or health of third parties, they are obliged to immediately inform the operator and/or persons authorized by the operator, the security service. Each visitor is responsible to the operator and/or any third party for harm caused as a result of their violation of the rules arising from these visitor rules and/or other binding legal regulations.

4.4 The operator is entitled to require the visitor to return any item that caused injury and/or harm to the operator and/or any third party.

4.5 Visitors are obliged to inform the operator and/or the security service of any injuries and/or harm occurring in the Mendel festival area.

4.6 In the event of an evacuation of the Mendel festival area or other emergency situations, visitors are obliged to follow the instructions of the operator and/or persons authorized by the operator, the security service, and/or components of the integrated rescue system.

5. Other Provisions
 
5.1 By entering the area, visitors to the Mendel festival agree, without further notice, to the free use of their image or likeness as part of any visual recording, transmission, or production of events held in the Mendel festival area for commercial or promotional purposes within the meaning of § 84 of Act No. 89/2012 Coll., Civil Code (hereinafter referred to as the “Civil Code”), as part of the display of the whole or part of the event organized in the Mendel festival area by the organizer and/or its contractual partners. Consent to the use of the image or likeness under this provision is granted by visitors to the organizer and its contractual partners for an indefinite period, whereby the visitor is entitled to revoke this consent, provided that the revocation is not justified by a significant change in circumstances or another reasonable reason, the visitor is liable to the organizer within the meaning of § 87 paragraph 2 of the Civil Code for any damage that arises as a result of the revocation of consent. The processing of personal data in the context of the use of visual recordings of visitors is governed by the information on the processing of personal data according to the previous paragraph.

The processing of personal data in the context of the use of visual recordings of visitors takes place on the legal basis of the legitimate interest of the organizer according to Article 6 paragraph 1 letter f) of Regulation (EU) 2016/679 (GDPR). The organizer does not process any personal data beyond visual recordings, and this exclusively for the purpose of documentation, promotion, and informing the public about the event. Visitors have the right to access their data, deletion, and other rights according to Articles 15–22 of GDPR. 5.2 Visitors to the Mendel festival further acknowledge that audio and/or visual recordings may be made in the Mendel festival area for the purposes of press, radio, television, or similar reporting. Visitors acknowledge that no consent is required for the making of these recordings within the meaning of § 89 of the Civil Code, provided that these recordings are used in a reasonable manner and that such use does not conflict with their legitimate interests.

6. Final Provisions

6.1 The rules set forth in these visitor rules may be further supplemented by rules relating to individual events organized in the Mendel festival area. These supplementary rules will always be suitably published in the Mendel festival area or available from the operator or the security service, and visitors are obliged to comply with them. These records will be made and stored in accordance with GDPR and methodological guidelines of the Office for Personal Data Protection.
  
6.3 These visitor rules come into effect on July 1, 2025.
 
6.4 Rights and obligations not expressly regulated in these visitor rules are governed by generally applicable legal regulations, especially Act No. 89/2012 Coll., Civil Code, as amended and effective.
 
6.5 The organizer reserves the right to change these visitor rules at any time.
